Spa Purchase Terms & Conditions

Terms and Conditions


1. Unless specified, the stated price is for the product only. Delivery, installation or set-up is extra.

2. If delivery is included in the total price, it is the customer’s responsibility to supply the additional help indicated on reverse to assist the driver to unload and position the product(s).

3. The customer is responsible for inspecting the product upon delivery and having the driver sign for verification of any deficiencies.

4. Where installation cannot be completed due to purchaser’s delivery conditions not being met, a charge may be applied for a return to complete the delivery.

5. All permits, accessory assembly, structural analysis, electrical hook-ups and repair of access are the sole responsibility of the purchaser.

6. Specific details of the warranty will be shipped with each unit. Advanced copies are available upon request from Discounter’s Pool & Spa.

7. All warranties are the responsibility of the manufacturer. Discounter's Pool & Spa cannot alter, amend or assume manufacturer warranties.

8. The customer acknowledges that he/she has made the necessary measurements and met structural conditions to ensure that the product can be placed in the desired location.

9. It is the customer’s responsibility to ensure that all sides of the spa are accessible in the event service is required. There is no labour coverage for time required to gain access to the spa.

10. Additional travel charges may apply to any service call. See manufacturer’s warranty for specific details.

11. If delivery is included in the purchase price, Discounter’s Pool & Spa will make every effort to deliver your product at the scheduled time. However due to unexpected circumstances, times may change. Discounter’s Pool & Spa Warehouse is not liable for any expenses incurred in the event delivery dates or times are changed.

12. In the event of default of payment, Discounter’s Pool & Spa may remove any unpaid goods without legal process of law from the location and shall have the rights therein and thereto of a secured party under the Personal Property Security Act.

13. Customers are expected to take delivery of their spa within 30 days of the requested date on this contract or date of contract if no required date is specified. Failure to do so may result in applied storage fees or forfeiture of all deposits.

14. Cancellation restocking charges are applied to the spa purchase price and are subject to applicable taxes.

15. Uncertified personal cheques will be held for 15 business days prior to release of any product.

16. The customer acknowledges that he/she has read the terms and conditions outlined above.
 
 
 

PRE-INSTALLATION GUIDELINES & REQUIREMENTS

A. Ensure proper electrical wire and ground fault circuit interrupter (GFCI) breaker is installed. Ensure there is ample wire to enter the spa and allow for flexibility during installation hook up.

B. Ensure there is a suitable level base to support the entire footprint of the unit. It is recommended that the base extend a minimum of 6” all around to allow for adjustments and ground maintenance.

C. Ensure that access and clearances are suitable for the model you have selected. All specifications are available within current literature or by consulting your nearest Discounter’s Pool & Spa Warehouse.

D. Measure for any gates (heights & widths), fences, doorways, railings, stairs, slopes, or obstructions that may appear to pose movement restrictions.

E. As per the purchase agreement, if additional assistance is required all assistants should be suitable to physically assist.

F. Spa orientation is included in purchase price. Please arrange with your local Discounter's Pool & Spa store for either an in store or online spa orientation tutorial.

If there are any uncertainties as to any of the above conditions, it is the responsibility of the purchaser to contact Discounter’s Pool & Spa prior to delivery and/or request a site visit.
 

By Purchasing a Spa on Pre-order; you agree too:

These Pre-Order Terms and Conditions (“Terms”) govern the placing of pre-orders ("Pre-order") with and Discounter’s Pool & Spa. Please read these Terms carefully before submitting your Pre-Order of any DPS’s Products. By submitting your Pre-Order, you agree to be legally bound by these terms.

1. Pre-Order Product Reservation

When placing a Pre-order for DPS products, you will be required to provide certain information, such as your address and other billing information. You represent and warrant that all such information is accurate, and you shall ensure that such information is kept current.

DPS shall have no responsibility or liability for inaccurate information or information that later becomes outdated and shall have no obligation to make efforts to determine the correct contact or shipping information.

You acknowledge and agree that DPS may decline or delay Product Reservations to avoid oversubscription or as it deems appropriate, we will make efforts to inform you within two (2) weeks of our receipt of your Pre-Order, and that you will be entitled to a full refund of the purchase Price.

2. Price & Payment

You will be charged the full Price of the Products at the time of placing the Pre-Order. The purchase price does not include import duties, taxes, transfer fees, shipping fees or other charges, which are Buyer’s responsibility.

Methods of payment online are limited to (1) Credit Card Payment (Visa, MasterCard, American Express), (2) PayPal, (3) Financing, subject to the 3rd party’s approval. Methods of payment in-store are limited to (1) Credit Card Payment (Visa, MasterCard, American Express), or (2) Interac Debit, (3) Cash, (4) Financing, subject to the 3rd party’s approval.

3. Priority

DPS will build Product Bundles according to the order in which Pre-orders are received. If you cancel or forfeit your Product Reservation in accordance with the Terms, your position will be taken by the next person on the Product Reservation list.

4. Delivery Schedule

Although we will make efforts to begin delivering Products as soon as reasonably practicable, you understand and agree that there may be delays. An estimated time of delivery is only an estimate, is subject to change, and DPS does not represent or warrant that it will be able to ship the Product by the estimated date. As a result, in the event that a delay arises and the estimated shipment is not met, DPS is not responsible for any damages that may occur due to the delay, nor shall it be obligated, except as set forth in these Terms, to provide any discounts, refunds or credits due to any such delays. We will provide you updates with respect to such delivery schedules. If for any reason you decide that you do not wish to continue to wait for your Product, you may cancel your Product Reservation as provided for in Section 5 below.

5. Cancellation

Buyer or Seller may cancel this Product Reservation by terminating the Pre-order at any time for any or no reason prior to our notice to you that your Product is ready for delivery. If you do so prior to our notice of delivery, you will obtain a refund of the purchase Price without interest. If DPS cancels your Product Reservation you will receive a full refund of the Purchase Price without interest.

6. Limitation of Liability

Under no circumstances will DPS be held liable for any incidental, special or consequential damages arising out or related to this agreement. In the event that DPS is held liable for any damages arising out or related to these Terms, your sole and exclusive remedy will be the full refund of your purchase price without interest.

7. Customer Information

We will use any information that we may collect about you only in accordance with our General Terms and Conditions.

8. Change to the “Terms”

DPS reserves the right to change any of the terms for any or no reason. We will provide notice of any material changes and, if you are unhappy with such changes, your sole and exclusive remedy will be to cancel your Product Reservation as described in Section 5 above.
